Terms of Service
These Terms govern restaurant use of PeckQ, a business waitlist service operated by IMPI TECH (PTY) LTD.
1. The parties and acceptance
“PeckQ”, “we”, “us”, or “our” means IMPI TECH (PTY) LTD, registration number 2016/356031/07, a private company registered in South Africa. “Customer”, “you”, or “your” means the restaurant business that creates or uses a PeckQ account. By creating an account, accepting these Terms at signup or checkout, or using the service, you agree to these Terms for that business.
You must be at least 18 and have authority to bind the restaurant. PeckQ is offered to business customers only, initially in South Africa and selected pilot markets.
2. The service
PeckQ provides a hosted restaurant waitlist. Guests scan a restaurant QR code, join the waitlist through WhatsApp, receive updates, and may exchange queue-related messages. Authorized restaurant users manage the queue through the PeckQ web dashboard. PeckQ is not a reservation, point-of-sale, emergency, or guaranteed guest-attendance service.
3. Accounts and security
You must provide accurate account information, keep authentication credentials secure, restrict access to authorized staff, and promptly tell us about suspected unauthorized use. You are responsible for account activity by your authorized users. We may use email or a supported identity provider such as Google to authenticate users.
4. Restaurant responsibilities
You are responsible for:
- using PeckQ and guest information lawfully and transparently;
- ensuring the displayed QR code belongs to the correct restaurant;
- setting reasonable wait estimates and making seating decisions;
- keeping staff access current and protecting guest confidentiality;
- obtaining notices or consents required for restaurant communications; and
- responding appropriately to guest requests for restaurant-controlled data.
5. Acceptable use
You must not use PeckQ unlawfully, fraudulently, abusively, to harass people, to send unsolicited marketing, to interfere with the service, to probe or bypass security, or to process information unrelated to genuine restaurant waitlist interactions. PeckQ is not a general WhatsApp inbox or customer-marketing platform.
6. Trial, price, and renewal
The standard monthly price is R349 per restaurant in ZAR, with no setup fee. A 14-day trial requires a payment method when started through checkout and automatically converts to a monthly paid subscription unless cancelled before the trial ends. The checkout shows the currency, taxes, total, first charge date, and renewal terms before purchase.
IMPI TECH is not currently VAT registered and does not add South African VAT. We may change prices with at least one month's prior notice; a price change applies no earlier than a later renewal date stated in that notice.
7. Payment processing
IMPI TECH (PTY) LTD is the seller of PeckQ. When checkout is enabled, PayFast processes the payment and stores the payment method needed for recurring billing. PeckQ does not receive or store complete payment-card details.
8. Cancellation, failed payment, and refunds
You may cancel during the trial to prevent the first charge, or cancel a paid plan with effect at the end of the current billing period. Access continues until that period ends. A failed payment receives a seven-day grace period; unresolved accounts may then be suspended. The Refund and Cancellation Policy forms part of these Terms.
9. Data protection
Each restaurant determines why guest waitlist data is used and is generally the responsible party/controller for that data. IMPI TECH generally acts as its operator/processor when running PeckQ for the restaurant. IMPI TECH is separately the responsible party/controller for restaurant-account, security, support, billing, and legal-compliance data. 10. Intellectual property and feedback
We and our licensors retain all rights in PeckQ, its software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use the service during an active trial or subscription. You retain rights in data submitted by or for your restaurant. You may provide feedback, which we may use without an obligation to compensate you.
11. Availability and changes
PeckQ has no public service-level agreement for the MVP. We use reasonable efforts to keep it available and, where practical, give reasonable notice of planned maintenance. Internet, WhatsApp, mobile-network, cloud-provider, and other third-party failures may affect the service. We may change the service where reasonably required for security, law, reliability, or product improvement without removing paid core functionality during a billing period without a reasonable remedy.
12. Suspension and termination
We may suspend access for material breach, unlawful or unsafe use, a security threat, or unresolved payment after the grace period. Where reasonably possible, we will notify you and allow a remediable breach to be corrected. Either party may end the agreement as permitted by these Terms. Data after termination follows the Privacy Policy, legal obligations, and valid deletion requests.
13. Warranties and liability
To the extent permitted by law, PeckQ is provided on an “as available” basis without a guarantee that every message will arrive or every guest will return. Nothing excludes a warranty, remedy, or liability that cannot legally be excluded.
To the extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or loss of profit, revenue, goodwill, or data. IMPI TECH's aggregate liability arising from the service is limited to the fees paid for PeckQ during the 12 months before the event giving rise to the claim. These exclusions and limits do not apply where prohibited by law or to fraud, wilful misconduct, or other liability that cannot legally be limited.
14. Governing law and disputes
South African law governs these Terms. Before starting formal proceedings, the parties will try in good faith for 30 days to resolve a dispute informally. Subject to rights that applicable law gives another forum, the courts of South Africa have jurisdiction.
15. General
If a provision is unenforceable, the remainder continues. A failure to enforce a right is not a waiver. You may not transfer the agreement without our consent; we may transfer it as part of a business reorganization or sale while preserving applicable protections. These Terms, the policies they incorporate, and the accepted checkout form the agreement for the service.
